ARTICLE 4 – TERMS AND CONDITIONS OF THE ORDER:

The customer has the possibility of making purchases directly on the meslentillesdecouleur.com website and thus placing their order for contactology products, multifunctional solutions for lenses and accessories remotely, within the strict framework of the regulatory provisions in force and the procedures which follow so that a qualified optician can constantly ensure the suitability of the products ordered for the prescription if this is necessary.

ARTICLE 5 – PRICE:

ARTICLE 6 – CONDITION OF PAYMENT:

ARTICLE 7 – CONCLUSION OF THE CONTRACT:

The conclusion of the contract is carried out only in French.

Products can only be delivered within the limits of available stocks.

In the event of a product being out of stock, the customer will be informed of the delay in their Order by email or directly by telephone, at the number indicated when placing their Order.

In accordance with the provisions of Article L221-24 of the Consumer Code, if the Order is cancelled due to unavailability of the product, the customer will be reimbursed for the full price of his Order within fourteen (14) days following the cancellation of this Order.

ARTICLE 8 – CONDITIONS OF SENDING AND DELIVERY:

For all products, shipments and deliveries are announced by email to the customer, to the email address provided by the latter in their personal space.

The customer can be offered several delivery methods in France and abroad.

Packages are generally shipped within 24 to 48 hours after the Order is placed, from Monday to Friday. It then takes 5 working days to receive the package in France. Unless there are delays in the postal services, or products are out of stock, the delivery time is therefore a maximum of 10 working days.

After receiving the Order, we will endeavor to respect the delivery time mentioned above and deliver the goods as quickly as possible.

In accordance with article 1218 of the civil code, the company AUVA VISION will not be held responsible in the event of absence or significant delay in delivery due to an event of force majeure.

ARTICLE 9 – RIGHT OF WITHDRAWAL:

The right of withdrawal only applies to natural persons.

In accordance with articles L. 121-20, the customer has 14 days (from receipt of the items) to exercise their right of withdrawal.

In case of request for exchange or refund, this customer returns the item provided that he has not opened the sterile compartment of the lenses nor opened the box which contains the two lens capsules. This customer has a period of 30 days, after placing the order, to make his request to customer service.

Return costs will be borne by the customer.

The return must include all products subject to the Order, new, in their original case to be accepted.

Contact lenses or care products unsealed by the consumer after delivery cannot be returned under the right of withdrawal for reasons of hygiene and safety.

For optical equipment, being medical devices adapted to the customer's specific needs, Auva Vision customer service checks the conformity of the package beforehand. Once the conformity has been confirmed, the refund will be made within 14 days from the refund request, to the customer's bank account used for payment.

If the return is requested due to non-conformity of the delivered products:

  • Damaged package;
  • Product with a defect;

A new identical product will be sent to the customer, at no additional cost, upon request to Customer Service, which can be reached at the following email address:

After the 14-day period, the right of return no longer applies. Return costs will be borne by the buyer. If the right of withdrawal is exercised, AUVA VISION is required to reimburse the amounts paid by the customer, free of charge, with the exception of return costs. The refund is due within a maximum of 21 days.

If AUVA VISION sends products that do not correspond to the Order, it will be possible to have an exchange, provided that the brand is informed as soon as possible and the products are returned in their original packaging, unopened, undamaged or unmarked within 14 days of receipt of the order.

If a package is returned to Auva Vision due to incorrect addressing (incomplete or incorrect address, name not legible on the mailbox, etc.), the following options will be offered to the customer:

  1. Redelivery Request : The customer may request redelivery of the package to a corrected address. However, the shipping costs associated with this new shipment will be the customer's responsibility and must be paid before redelivery.

  2. Order Cancellation : The customer may cancel their order. In this case, only the price of the items will be refunded. The initial shipping costs will not be refunded, as they were incurred for the first shipment.

These conditions apply in all cases of failure to address attributable to the customer, and no refund of shipping costs will be granted in this situation.

A payment cannot be disputed or cancelled if the product has been sent and has not been returned to AUVA VISION. If the customer cancels their payment while the product is in their possession, AUVA VISION will be obliged to take legal action for fraud.

It is possible to cancel the Order: if the Order has just been placed and it has not yet been shipped, it will be possible to modify or cancel it by contacting customer service by email (auvavision@outlook.fr)

Orders placed before 1 p.m. on business days are generally shipped the same day. It is therefore recommended to contact Customer Service as soon as possible for cancellation.

Exclusion of the right of withdrawal for custom-made lenses

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for products made to the consumer's specifications or clearly personalized. As such, AUVA VISION informs its customers that contact lenses ordered to measure cannot be returned, exchanged or refunded , whatever the reason.

This provision concerns in particular, but not exclusively, lenses of the following brands: Adore, Bella, Dahab, Solotica, Air Optix, Soleko, Acuvue, Biotrue, Dailies, Biofinity, Soflens, PureVision and Proclear . As these products are manufactured or ordered specifically according to the needs or choices of the customer (corrections, colors, curvatures, etc.), they cannot be put back on sale and are therefore excluded from any withdrawal procedure.

ARTICLE 10 – CONFORMITY OF PRODUCTS:

The information mentioned on each product description sheet is that communicated by the suppliers from whom AUVA VISION has obtained its supplies.

The products sold on the site are strictly compliant with current regulations and meet applicable French and European standards. Suppliers have provided product conformity certificates. These certificates are held by the Company.

Corrective colored lenses are medical devices within the meaning of article L5211-1 of the public health code.

In accordance with the provisions of Article L5211-3 of the Public Health Code, these corrective lenses have a CE marking. Finally, corrective lenses are declared to the ANSM in accordance with the provisions of Article L5211-3-1 of the Public Health Code.

At My Colored Contact Lenses, we pride ourselves on providing you with quality products. However, if an anomaly is noticed with your colored contact lenses, our customer service team is here to assist you. To ensure your request is processed quickly and efficiently, it is imperative that you provide us with the following information:

> A photo of the affected lenses: Take a clear, well-lit photo of the lenses. This will allow our team to accurately analyze the problem (e.g., a visible defect on the lens).

> A photo of the box of the affected lenses: The box of your colored lenses is essential to identify the affected product. We need a photo of the part where the following details are indicated: Batch number, model name, prescription.

This information allows us to trace the manufacturing of the product and better understand the situation.

IMPORTANT: If these two elements cannot be provided, customer service will not be able to continue processing your file. In this case, it will be immediately closed.

ARTICLE 11 – RESPONSIBILITIES:

The products comply with the regulations and standards in force in France.

As a distributor of medical devices in France, AUVA VISION has a responsibility towards the customer.

AUVA VISION is therefore held responsible in the event of non-compliance with the legislation on the sale of corrective lenses in force in France.

ARTICLE 12 – LEGAL GUARANTEES:

Legal guarantees apply regardless of any commercial guarantee that may be granted.

Guarantee of conformity

Reproduction of articles L 217-4, L 217-5 and L 217-12 of the Consumer Code

Article L. 217-4 : “The seller delivers goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when this has been made his responsibility by the contract or has been carried out under his responsibility.”

Article L. 217-5 : “The property is in conformity with the contract:

  1. If it is suitable for the use usually expected of a similar good and, where applicable:

- if it corresponds to the description given by the seller and has the qualities that the latter presented to the buyer in the form of a sample or model;

- if it presents the qualities that a buyer can legitimately expect in view of the public statements made by the seller, by the producer or his representative, in particular in advertising or labeling

  1. Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.

Article L. 217-12 : “The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods”.

Article 2232 paragraph 1 of the Civil Code : "The postponement of the starting point, the suspension or the interruption of the limitation period cannot have the effect of extending the period of extinctive limitation beyond 20 years from the day the right arose."

When acting under the legal guarantee of conformity, the customer:

- has a period of 2 years from delivery of the goods to take action;

- may choose between repair and replacement of the goods, subject to the cost conditions provided for in Article L. 217-9 of the Consumer Code;

- is exempt from providing proof of the existence of the lack of conformity of the goods during the 6 months following delivery of the goods. This period is extended to 24 months from 03/18/2016, except for used goods.

Guarantees relating to hidden defects
Reproduction of articles 1641, 1647 paragraph 1 and 2231 paragraph 1 of the Civil Code

Article 1641 : "The seller is bound by the guarantee for hidden defects in the thing sold which make it unfit for the use for which it is intended, or which so diminish this use that the buyer would not have acquired it, or would only have paid a lower price for it, if he had known of them."

Article 1648 paragraph 1 : “The action resulting from latent defects must be brought by the purchaser, “within two years of the discovery of the defect”.

Article 2232 paragraph 1 of the Civil Code : "The postponement of the starting point, the suspension or the interruption of the limitation period cannot have the effect of extending the period of extinctive limitation beyond 20 years from the day the right arose."

The Customer may decide to implement the guarantee against hidden defects of the item sold within the meaning of Article 1641 of the Civil Code. In this case, he may choose between the cancellation of the sale and a reduction of the sale price in accordance with Article 1644 of the Civil Code.

ARTICLE 16 - SECURITY:
REPORT AN ADVERSE EFFECT

The Customer may also send any report or alert concerning a product that presents an adverse effect to the National Agency for the Safety of Medicines (ANSM) and Health Products via the following link: link.

This article provides that mandatory or optional reporting is carried out by manufacturers or their agents, distributors, users or patients and any other third party who has become aware of incidents or risks of incidents.

If there is any stinging or redness in the eyes, the Customer is asked to remove the lenses immediately and stop wearing them.

By placing an order, the Customer agrees to follow the instructions for use to ensure the health and hygiene of their eyes.

AUVA VISION declines all responsibility for misuse, mishandling, and poor storage of contact lenses ordered on this site.
